A charge doesn’t equal a conviction.

In June of 2015, the old law for Domestic Violence was amended. The new law divides the consequences of a DV conviction into “degrees” instead of a defendant’s number of offenses as classified in the old statute.  

• 1st Degree is a felony and can carry a sentence of 0-10 years in jail.
• 2nd Degree is a misdemeanor and can carry a sentence of 0-3 years in jail or a fine of $2,500-$5,000.
• 3rd Degree is a misdemeanor and can carry a sentence of 0-90 days in jail or a fine of $1,000-$2,500.
• Domestic Violence of a High and Aggravated Nature is a felony and can carry a sentence of up to 20 years in jail.

Remember however, with costs and assessments, that fine can more than double!  Don’t put yourself at risk of being subjected to these extensive penalties without having an experienced Summerville Criminal Domestic Violence attorney look over your case.
